Perhaps unsurprising, your co-parenting challenges may not always end just because the divorce or custody case does. Your first option is to return to court. You would return to court by filing a motion to change custody or modify a parenting plan or a motion for contempt if you feel that the other party isn’t complying with court orders. However, you may not wish to go back to court because it is stressful, expensive, time-consuming, or simply because you just don’t see how a new court order will resolve any of your parenting conflicts.

Jordan Speaking: In litigation, once the trial finally occurs, it may take several months to get a decision from the court. In mediation, however, once the parties reach an agreement, the mediator types up this agreement and sends it to the party’s attorneys for review. It is then drafted into a decree, separation agreement, or agreed entry, and will be filed once the agreement is formally drafted, signed by all parties, and filed with the court.

Jordan speaking: I think clients underestimate the impact that litigation has on a person and their family. They often think that court is where you’re supposed to go to seek justice, and there will be a winner and a loser. Unfortunately, relying on the court to make a decision for your family often leaves you with unintended results. Even if you won, you may find that the decision ignores major issues that were really important to you. Mediation, however, allows the parents, not the judges, to decide matters that will affect what is most important to you. Most importantly, mediation allows you to have total control over the outcome of your case.
